Vaginal Mesh Victim Awarded $11.1 Million by a New Jersey Jury

A New Jersey jury awarded Linda Gross $11.11 million in damages for the injuries she suffered from her Prolift transvaginal mesh device.   The jury awarded $3.3 million in compensatory damages and $7.7 million in punitive damages.  The jury found that Johnson & Johnson, the manufacture of the device, failed to warn and made fraudulent misrepresentations about the transvaginal mesh product.

Gross had a Prolift transvaginal mesh device implanted to treat pelvic organ prolapsed, which is a condition where internal organs drop into the vagina.   The device caused Linda to suffer constant pain.  She was barely able to sit and found intercourse to be extremely painful as the implant eroded through organ walls.  The device caused Linda to have 18 operations after the device was implanted.

During the trial, Gross’s lawyers presented internal company documents that revealed that Johnson & Johnson knew that the mesh would cause pain and harm.

Gross’ case  was the first transvaginal mesh case to go to trial.  The success of the case is important to all transvaginal mesh cases, as it demonstrates how a jury may award damages in similar cases.

Gross is not the only woman who has been harmed by the transvaginal mesh.  It is estimated that thousands of other women have been harmed by transvaginal mesh implants.
